1. Acceptance of Terms

By registering for an account, purchasing a subscription, accessing the Buildur.ai Platform, or using any part of our Service, you agree to be bound by these Terms and Conditions, our Privacy Policy, and all policies incorporated herein by reference.

If you do not agree to these Terms, you are not authorized to use the Service. Bytwise LLC reserves the right to modify these Terms at any time. Material changes will be effective upon notice to you (for example, via email or a prominent notice on the Platform), and your continued use of the Service constitutes acceptance of the updated Terms.

2. Services Provided

2.1 Overview

Buildur.ai provides AI-driven resume analysis, opportunity matching, email drafting, and workflow management tools designed to help professionals enhance their profiles and career development.

2.2 Core Features

• Resume/CV upload and AI-based parsing and analysis.
• Domain classification and skill-based categorization.
• Profile strength scoring and gap identification.
• Opportunity discovery and recommendations (conferences, speaking roles, peer-reviewing positions, editorial committees, hackathon judging, etc.).
• AI-generated outreach email drafting (fully editable by users).
• Application workflow dashboard with saved opportunities, status tracking, notes, and reminders.

2.3 Limitations

• All recommendations and opportunity matches are AI-generated and advisory in nature.
• Buildur.ai does not guarantee acceptance, selection, or success in external opportunities.
• External event organizers, hiring committees, and other third parties make independent decisions based on their own criteria; Buildur.ai is not responsible for their outcomes.
• Users must comply with all terms and conditions of external platforms or organizations when applying to opportunities.

3. Account Registration and Security

3.1 Account Requirements

To use Buildur.ai, you must:

• Be at least 16 years of age.
• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality of your account credentials (email and password).
• Notify Bytwise immediately of any unauthorized access or suspected misuse of your account.

3.2 Your Responsibility

You are solely responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account, and for notifying Bytwise of any unauthorized use. Bytwise is not liable for losses or damages resulting from unauthorized access to your account due to your failure to maintain confidentiality.

4. User Responsibilities

4.1 Accuracy of Information

You represent and warrant that:

• All information you provide is true, accurate, current, and complete.
• You have the right to provide the information (including resume/CV, professional data, and any uploads).
• You will not upload documents or data belonging to third parties without their explicit consent.

4.2 Lawful Use

You agree to use Buildur.ai only for lawful, legitimate professional purposes and in compliance with all applicable laws and regulations.

5. Intellectual Property

5.1 Bytwise IP Rights

All content, technology, algorithms, designs, and features of the Buildur.ai Platform (including AI models, scoring systems, opportunity-matching logic, and user interfaces) are owned or licensed by Bytwise LLC and are protected by copyright, trademark, patent, and other intellectual property laws.

5.2 User Content License

You retain ownership of your resume, CV, and other professional data you upload ("User Content"). By uploading User Content to Buildur.ai, you grant Bytwise a limited, non-exclusive, worldwide license to process, analyze, and display User Content for the purpose of providing the Service, and to use aggregated or de-identified data derived from User Content for research, product improvement, and analytics. This license is revocable upon account deletion, except for aggregated/anonymized data.

6. Subscription, Payment, and Refunds

6.1 Subscription Tiers

Buildur.ai offers various subscription tiers with different features, usage limits, and pricing. Subscription details are displayed during the sign-up process.

6.2 Billing and Renewals

Subscriptions renew automatically on your billing date unless you cancel. You authorize Bytwise (through third-party payment processors such as Stripe or Razorpay) to charge your payment method for the subscription fee. If payment fails, Bytwise may attempt to retry or suspend your account pending payment.

7. Non-Refund Policy (Explicit)

7.1 Non-Refundable Fees

ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE UNDER ALL CIRCUMSTANCES. This includes full subscription periods that have already been charged, partial or unused subscription periods, fees charged in error (except for duplicate charges, which will be investigated and corrected), fees for services not rendered due to account suspension or termination, and cancellations for any reason, including dissatisfaction with the Service.

8. Limitation of Liability

8.1 Disclaimer

BYTWISE LLC PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. BYTWISE DOES NOT WARRANT THAT the Service will be uninterrupted, error-free, or secure; that all AI-generated recommendations or opportunity matches are accurate or suitable for you; that external opportunities will result in acceptance, selection, or success; or that the Service will meet your expectations or requirements.

9. Indemnification

9.1 Your Indemnification Obligation

You agree to indemnify, defend, and hold harmless Bytwise LLC, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from or related to your use or misuse of the Service, your violation of these Terms or applicable law, your infringement or violation of any third-party intellectual property, privacy, or other rights, your breach of any representation or warranty made in these Terms, or your upload or submission of third-party content without proper authorization.

10. Termination and Suspension

10.1 Termination by User

You may terminate your account and subscription at any time by contacting support or using the account settings. Termination does not entitle you to any refund.

10.2 Termination by Bytwise

Bytwise may suspend or terminate your account or access to the Service immediately, without notice, if you violate these Terms or our Privacy Policy, engage in fraudulent, abusive, or illegal activities, misuse the Service or upload unauthorized or illegal content, fail to pay fees or if payment is declined, or if Bytwise reasonably believes your account poses a security or legal risk.

11. Disclaimers and Warranties

11.1 No Warranty of Accuracy

Buildur.ai provides AI-generated analyses and recommendations for informational purposes only. We do not warrant the accuracy, completeness, or suitability of any recommendations. You acknowledge that AI models can produce errors or misclassifications; opportunity recommendations are based on the information you provide and may not reflect all available opportunities; and external organizations make independent decisions; Buildur.ai does not guarantee outcomes.

12. Use of AI and Automated Systems

12.1 AI-Generated Content

Buildur.ai uses artificial intelligence to analyze resumes, draft emails, score profiles, and recommend opportunities. Such content is generated by automated algorithms, not human experts, is provided for your review and editing; you are responsible for final accuracy and appropriateness, and is subject to errors, biases, or misclassifications inherent to AI systems.

13. User Content and Submissions

13.1 Content Responsibility

You are responsible for all content you upload, submit, or create through the Service, including resumes, CVs, notes, and communications.

14. Acceptable Use Policy

14.1 Permitted Use

You agree to use Buildur.ai only for legitimate, lawful professional purposes in accordance with these Terms and all applicable laws.

15. Prohibited Activities

15.1 System Abuse

You may not:

• Engage in activities that disrupt or overload the Service (for example, launching denial-of-service attacks).
• Attempt to bypass security measures or access unauthorized areas.
• Use automated scripts or bots to access the Service (except as explicitly authorized).
• Create multiple accounts to circumvent limitations or exploit promotions.

16. Intellectual Property Infringement (DMCA)

If you believe that content on Buildur.ai infringes your copyright or intellectual property rights, you may submit a notice under the Digital Millennium Copyright Act (DMCA).

17. Third-Party Services and Integrations

17.1 External Platforms

Buildur.ai may integrate with third-party services such as email providers (Google Gmail, Outlook, etc.), payment processors (Stripe, Razorpay, etc.), and event platforms and opportunity databases.

18. Modifications to Service

Bytwise reserves the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, for any reason or no reason.

19. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles.

20. Dispute Resolution

20.1 Informal Resolution

Before initiating formal legal action, you agree to attempt good-faith resolution of any dispute by contacting Bytwise at legal@buildur.ai with a detailed description of the issue.

21. Entire Agreement

21.1 Complete Terms

These Terms and Conditions, along with the Privacy Policy, constitute the entire agreement between you and Bytwise regarding the Service and supersede all prior agreements, negotiations, and understandings, whether written or oral.

22. Severability

22.1 Invalid Provisions

If any provision of these Terms is found to be invalid, unenforceable, or illegal, that provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, it shall be severed. The remaining provisions shall remain in full force and effect.
